Saturday, March 15th, 2008

Let’s look at this above statement

This above position taken by the NASD is what continues the problems with the Variable Annuity industry because there is no official position taken on suitability and in it’s marketing of living benefits to the seniors/retirees that are led to purchase a risk product with a false sense of safety conveyed that somehow their money is really not at risk.

Wednesday, February 20th, 2008

Trees can be a nuisance.

Common Law recognizes two types of nuisance: public nuisance and private nuisance. A public nuisance is defined as an unlawful act or omission, which endangers the safety or comfort of the public. Examples of public nuisance include obstructing a highway, keeping a common gaming house or selling unwholesome provisions. On the other hand, there are two types of private nuisance. The first involves any wrongful disturbance of an easement or other right in respect of land. The second, by far the most common, involves the act of wrongfully causing or allowing the escape of injurious things onto another person’s land such as, for example, water, smoke, smells, fumes, gas, noise, heat, electricity, vibrations, animals and vegetation.

Intellectual Property - Patent Law, Copyrights, And Trademarks

Tuesday, February 12th, 2008

Patent law is intended to give a temporary monopoly to the inventor to make and sell his invention. The period of the patent is limited but it keeps others from making, using, selling or importing the product. It is a license that can be sold, assigned or transferred. A patent is only good in the country where it is issued so patents must be obtained in all desired countries.

A patent is for a specific length of time. It is usually twenty years. When a patent reaches its expiration date the use of the invention is open to all interested parties. Annual renewal fees are to be paid each year during the term of the patent.

Why Site Owners Must Know California Internet Regulations

Sunday, February 10th, 2008

Most sites on the web are at least faintly familiar with the implementation of legal regulations related to their sites. Most, however, have never heard of the California Catch-22.

Most sites tend to view complying with legal regulations as a somewhat amorphous subject. You know you are supposed to do something, but are not particularly sure why or what to do. This leads to the rather humorous situation where many sites have terms and conditions that are completely inapplicable the what they are doing and also look startlingly similar to terms and conditions found on other sites. One might even imagine a bit of “cut and paste” was going on, but who am I to say!
